1. About Ganusii and These Terms
These Terms of Service ("Terms") govern your access to and use of the Ganusii website at ganusii.com and any related services, platforms, or communications (collectively, the "Service") operated by Undaunted Lab ("Ganusii", "we", "us", or "our"), a business based in Lagos, Nigeria.
By accessing our website, completing a registration form, joining a WhatsApp corridor group, or otherwise using the Service, you ("User", "you") agree to be bound by these Terms. These Terms should be read together with our Privacy Policy, which is incorporated into these Terms by reference.
If you are using Ganusii on behalf of a company or organisation, you represent that you have authority to bind that entity to these Terms.
2. What Ganusii Is and Is Not
2.1 What Ganusii is
Ganusii is a peer-to-peer carpooling matching platform. We use AI-powered corridor analysis to match Lagos-based working professionals who share similar daily commute routes, enabling them to share private vehicle rides and split costs on a voluntary basis.
Ganusii coordinates introductions and matching. The actual ride is a voluntary arrangement between a Driver (a private individual) and one or more Riders (other private individuals), facilitated through WhatsApp.
2.2 What Ganusii is not
Drivers on Ganusii are private individuals sharing their personal vehicles as part of their own daily commute, not commercial operators carrying passengers for hire. The arrangement is cost-sharing, not a commercial transport service.
Ganusii does not represent that any Driver is licensed as a commercial transport operator, nor do we hold a commercial transport licence on behalf of any Driver. Users engage in ride-sharing arrangements at their own discretion and risk, subject to these Terms and applicable Nigerian law.
2.3 Pre-launch status
As of the effective date of these Terms, Ganusii is in pre-launch / waitlist phase. We are collecting expressions of interest to validate corridor demand. No rides are currently being matched or operated. These Terms govern both the pre-launch period and any future live service.
3. Eligibility
To use the Ganusii Service, you must:
- Be at least 18 years of age
- Be a working professional based in Lagos, Nigeria (or have a regular commute within the Lagos metropolitan area)
- Have the legal capacity to enter into a binding contract under Nigerian law
- Not be prohibited from using the Service under any applicable law or regulation
- Provide accurate, truthful, and complete information during registration
Drivers must additionally:
- Hold a valid Nigerian driver's licence
- Own or have documented authorisation to use the vehicle they intend to share
- Hold at least third-party motor vehicle insurance as required by Nigerian law
- Ensure their vehicle is roadworthy and complies with Lagos State traffic regulations
We reserve the right to refuse registration or terminate access for any user who does not meet these eligibility requirements or who provides false information.
4. Registration and the Waitlist
To join the Ganusii waitlist, you must complete our online registration form and provide the information requested. By submitting the form, you:
- Confirm that all information provided is accurate and up to date
- Consent to Ganusii processing your personal data as described in our Privacy Policy
- Agree to be contacted by Ganusii via email and/or WhatsApp with updates about your corridor's launch status
Joining the waitlist does not guarantee a place in any corridor group, does not create a contractual obligation on Ganusii to launch any particular corridor, and does not entitle you to any payment, compensation, or benefit if a corridor is delayed or not launched.
Ganusii reserves the right to prioritise, reorder, or modify waitlist allocations at any time based on corridor demand, geographic clustering, or operational requirements.
You are responsible for maintaining the accuracy of your registration details. You may update or delete your registration at any time by contacting us at hello@ganusii.com.
5. User Obligations — All Users
All Ganusii users (Riders and Drivers) agree to:
- Treat other users with respect. Ganusii is a professional community. Harassment, abuse, discrimination, or intimidation of any kind — based on gender, ethnicity, religion, age, disability, or any other characteristic — is strictly prohibited.
- Maintain accurate profile information. You must not misrepresent your identity, employment, address, vehicle details, or any other material information.
- Act in good faith. Arrange and honour agreed pickup times and routes. Repeated cancellations or no-shows may result in suspension from the platform.
- Respect privacy. Do not share other users' personal details (names, phone numbers, home addresses) outside of the corridor group without their express consent.
- Report concerns promptly. If you experience or witness unsafe behaviour, report it to Ganusii at safety@ganusii.com or via WhatsApp immediately.
- Comply with Nigerian law. You are responsible for ensuring that your participation in carpooling complies with all applicable Lagos State and Federal laws and regulations.
6. Rider-Specific Terms
As a Rider on Ganusii, you acknowledge and agree that:
- You are sharing a private vehicle with another professional as a cost-sharing arrangement, not hiring a taxi or commercial transport service.
- Ganusii is a matching and coordination intermediary only. Your transport contract, such as it exists, is with the Driver — not with Ganusii.
- You will be ready at the agreed pickup location at the agreed time. Repeated lateness or missed pickups may result in removal from a corridor group.
- You will pay your agreed share of the fare directly to the Driver in the manner agreed within your corridor group. Ganusii is not a party to any fare payment arrangement in the pre-launch phase.
- You must not behave in a way that distracts or endangers the Driver while the vehicle is in motion.
- You ride at your own risk. Ganusii makes no warranty as to the roadworthiness of any vehicle or the driving standard of any Driver, beyond the verification steps described in Section 8.
7. Driver-Specific Terms
As a Driver on Ganusii, you acknowledge and agree that:
- You are a private individual sharing your personal vehicle as part of your own daily commute. You are not a commercial transport operator and must not represent yourself as one.
- You hold sole legal responsibility for the operation, roadworthiness, insurance, and licensing of your vehicle. Ganusii accepts no liability for any vehicle-related matter.
- You hold a valid Nigerian driver's licence and at minimum third-party motor vehicle insurance as required by Nigerian law. You must ensure this insurance covers passenger carriage in a cost-sharing arrangement. We strongly recommend confirming this with your insurer before taking any Riders.
- Fares charged must be a genuine cost-share (fuel, tolls, wear) and must not constitute a profit-making commercial fare. Operating as an unlicensed commercial carrier is a violation of Nigerian transport law and these Terms.
- You will not use alcohol, drugs, or any substance that impairs driving ability before or during any shared ride.
- You must not carry more passengers than your vehicle's legal seating capacity and your stated available seats on Ganusii.
- You consent to Ganusii conducting basic identity and vehicle verification as a condition of being matched with Riders (see Section 8).
- You accept that Ganusii may remove you from any corridor group if your verification status expires, if safety concerns are raised, or if you repeatedly fail to meet your corridor commitments.
8. Safety and Verification
The safety of our users is our highest priority. Before any Driver is matched with Riders on a live corridor, Ganusii will conduct a basic verification process that may include:
- Government-issued photo ID verification (e.g., NIN, International Passport, Driver's Licence)
- Confirmation of vehicle ownership or authorised use
- Basic employment or professional verification
- Review of vehicle details (type, year, plate number)
Riders may also be subject to identity verification before being matched with corridor groups.
Important limitation: While we take reasonable steps to verify the identity and credentials of users, we cannot guarantee the accuracy of information provided by users, or predict or prevent all risks associated with personal travel. Our verification process is a reasonable precaution, not an absolute guarantee of safety. Users accept this inherent limitation by participating in the Service.
If you feel unsafe during a ride or in your corridor group, you should contact emergency services (112 in Nigeria) immediately, then notify Ganusii at safety@ganusii.com.
9. Payments and Fares
9.1 Pre-launch phase
During the current pre-launch and waitlist phase, no payments are collected by Ganusii. Joining the waitlist is entirely free.
9.2 Live corridors (future)
When corridors go live, the following principles will apply:
- Fares between Riders and Drivers are a voluntary cost-sharing arrangement. The amount shared should reflect a genuine contribution to the Driver's fuel, toll, and vehicle running costs — not a commercial profit.
- Ganusii may introduce platform fees, transaction facilitation, or a service charge in the future. Any such fees will be clearly communicated and will require your consent before implementation.
- Payment arrangements in the initial pilot phase are agreed directly between corridor group members via WhatsApp. Ganusii does not process or hold payments during this phase.
9.3 Refunds and disputes
Ganusii is not a party to any financial arrangement between Riders and Drivers in the peer-to-peer phase. Fare disputes must be resolved between the parties directly. Ganusii may assist in mediation but accepts no financial liability for fare-related disputes.
10. WhatsApp Corridor Communities
Ganusii uses WhatsApp groups to coordinate matched corridor communities. By joining a Ganusii WhatsApp corridor group, you agree to:
- Use the group solely for the purpose of coordinating Ganusii carpool rides on your corridor
- Treat all group members with professionalism and respect
- Not share any member's personal information outside the group without their consent
- Not post spam, unsolicited commercial messages, offensive material, or content unrelated to corridor coordination
- Respect group administrators' reasonable rules and instructions
Ganusii or a designated administrator may remove any user from a WhatsApp group for conduct that violates these Terms or disrupts the community. WhatsApp's own Terms of Service apply to your use of WhatsApp as a platform.
Please note that WhatsApp is a third-party platform operated by Meta. Ganusii is not responsible for WhatsApp's privacy practices, service interruptions, or any data shared on WhatsApp beyond what we collect directly through our registration forms.
11. Prohibited Conduct
You must not use the Ganusii Service to:
- Provide false or misleading information during registration or verification
- Impersonate any person, including other Ganusii users or Ganusii staff
- Operate as an unlicensed commercial carrier or profit-making taxi service under the guise of carpooling
- Harass, threaten, abuse, or discriminate against any other user
- Engage in or facilitate any illegal activity, including but not limited to drug trafficking, fraud, or money laundering
- Collect, scrape, or harvest other users' personal data without their consent
- Interfere with or disrupt the operation of the Ganusii website, servers, or networks
- Circumvent any security or access control measures on the Service
- Use the Service to send unsolicited marketing communications to other users
- Resell, sublicense, or commercially exploit access to the Service without our written consent
Violation of any of the above may result in immediate suspension or termination of your access to the Service, and may be reported to the appropriate authorities.
12. Intellectual Property
All content on the Ganusii website — including the name "Ganusii", the Ganusii logo, website design, text, graphics, images, code, and the AI matching methodology — is the intellectual property of Undaunted Lab and is protected by Nigerian and international copyright, trademark, and related laws.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any part of the Service without our prior written permission.
By submitting any content, feedback, or suggestions to Ganusii (including via our forms, email, or WhatsApp), you grant Undaunted Lab a non-exclusive, royalty-free, worldwide licence to use, reproduce, and incorporate that content for the purposes of operating and improving the Service.
13. Disclaimers and Limitation of Liability
13.1 No warranty on rides
Ganusii provides a matching and coordination platform only. We make no representation or warranty — express or implied — as to the safety, quality, punctuality, or suitability of any ride arranged through the Service. All rides are arranged between private individuals at their own risk.
13.2 No transport liability
Ganusii is not a transport company and accepts no liability for any accident, injury, loss, damage, or death arising from any ride arranged through the Service. Any claim arising from a road incident or transport arrangement must be directed to the Driver's motor insurance provider and/or the responsible parties.
13.3 Service availability
We do not guarantee that the Service will be available at all times or free from errors. We may suspend, modify, or discontinue the Service (or any corridor) at any time with reasonable notice, and accept no liability for any resulting inconvenience or loss.
13.4 Limitation of liability
To the fullest extent permitted by Nigerian law, Ganusii's total aggregate liability to any user for any claim arising from or in connection with the Service — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — shall not exceed the amount (if any) paid by you to Ganusii in the three (3) months preceding the event giving rise to the claim, or ₦50,000 (Fifty Thousand Naira), whichever is lower.
This limitation does not apply to liability for death or personal injury caused by our negligence, liability for fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
13.5 Third-party services
Ganusii uses third-party tools including Airtable, WhatsApp, Google, and Meta. We are not responsible for any disruption, data breach, or failure attributable to these third-party services.
14. Indemnification
You agree to indemnify, defend, and hold harmless Undaunted Lab, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:
- Your access to or use of the Service
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Any ride you participate in as a Driver or Rider
- Any false or misleading information you provided during registration
- Any dispute between you and another user of the Service
15. Termination and Suspension
You may stop using the Service at any time by contacting us at hello@ganusii.com to request removal from the waitlist and deletion of your data.
Ganusii reserves the right to suspend or terminate your access to the Service — without notice in serious cases — if:
- You violate these Terms or any applicable law
- We receive credible reports of unsafe or abusive behaviour involving you
- You provide false information during registration or verification
- Your participation is, in our reasonable judgment, harmful to the community or the Service
- We cease to operate the Service or any particular corridor
Termination does not affect any rights or obligations that arose prior to termination. Sections 12, 13, 14, and 17 of these Terms survive termination.
16. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will:
- Update the "Last updated" date at the top of this page
- Notify registered users by email or WhatsApp at least 14 days before the changes take effect (for material changes)
- Post a notice on the Ganusii website homepage
If you continue to use the Service after updated Terms take effect, you accept the revised Terms. If you do not agree to the changes, you should stop using the Service and request deletion of your account data.
17. Governing Law and Dispute Resolution
17.1 Governing law
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
17.2 Informal resolution
We encourage you to contact us first at hello@ganusii.com if you have any complaint or dispute. We will attempt to resolve any issue informally within 14 days of receiving written notice.
17.3 Formal dispute resolution
If a dispute cannot be resolved informally, the parties agree to submit to the non-exclusive jurisdiction of the courts of Lagos State, Nigeria. You may also have the right to refer consumer complaints to the Federal Competition and Consumer Protection Commission (FCCPC) at fccpc.gov.ng.
18. Severability and Entire Agreement
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be severed from the remaining Terms, which shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ganusii in relation to the Service and supersede all prior representations, warranties, agreements, or understandings, whether written or oral.
Our failure to enforce any provision of these Terms shall not be construed as a waiver of that provision or any other right.
